Terms of Service
Last updated October 11, 2026
The agreement
These terms are an agreement between you and WAXED Industries, LLC ("WAXED," "we," "us"), 484 Harman Street, 1F, Brooklyn, NY 11237, United States. They apply whenever you use waxed.market, the WAXED iOS app, or any other WAXED service (together, the "Service").
By creating an account or signing in, you agree to these terms and to our Privacy Policy, including how we use the photos you take with the scanner. If you do not agree, do not use the Service.
Eligibility and your account
You must be at least 13 years old to use WAXED, and at least 18 (or the age of majority where you live) to buy or sell on the marketplace. If you use WAXED for a business, you confirm you are authorised to accept these terms on its behalf.
Keep your sign-in details secure and your account information accurate. You are responsible for activity on your account. Tell us promptly at info@waxed.market if you think someone else has accessed it.
The Service
Catalog. A searchable catalog of recorded music releases, artists, and labels, with pricing information and listening links. Catalog data comes from many sources — including Discogs and contributions from users — and may be incomplete or wrong. Price estimates are estimates, not appraisals or offers.
Scanner. The app can identify a record from a photo of its cover, label, or barcode and add it to your collection. Recognition is automated and can be mistaken; check a match before relying on it, especially before listing or buying.
Marketplace. Independent sellers list records, and buyers purchase them through WAXED. Payments are processed by Stripe.
Fees. WAXED charges sellers a flat 8% fee on the item price of each completed sale. It is not charged on shipping. Listing is free, and there are no subscriptions or membership tiers. Payment processing fees charged by Stripe are deducted from the seller's payout. Buyers pay the listed price plus shipping and any applicable tax. We will give notice before changing the fee; a change never applies to a sale already made.
We are continually changing the Service. Parts of it are offered in early or test form and may change, pause, or be withdrawn.
Your content and scan photos
"Your content" means anything you upload or create on WAXED: listings, listing photos, collection data, crates, reviews, messages, support conversations, and the photos you take with the scanner. You keep ownership of your content, and you confirm that you have the right to share it.
You give WAXED a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute your content as needed to operate and promote the Service — for example, showing your listings to buyers. For content you make public, this licence lasts while the content is on WAXED and for a reasonable period after you remove it.
Scan photos. When you scan a record, the scanner keeps a cropped image of it along with the match results and image-quality measurements. For those scan photos you give WAXED a worldwide, non-exclusive, royalty-free, perpetual, irrevocable licence to store, use, copy, modify, and create derivative data from them, in order to operate, build, and improve WAXED's products and data — including record recognition, condition and grading models, and catalog imagery. Scan photos are linked to your account while it exists. If you delete your account, they are de-identified (the link to you is removed) and may be kept in that form. The Privacy Policy explains this in more detail.
You can turn off the use of your scan photos for recognition and grading data in the WAXED app, under "Help improve recognition and grading" in Account & listening. While it is off, new scans are used only to identify the record for you and run your account, and their photos are not kept. Scans made while it was on stay covered by the licence above.
Please do not photograph people, documents, or anything other than the record you are scanning.
Acceptable use
You agree not to:
- list counterfeit, bootleg, stolen, or unlawful items, or misdescribe an item's condition;
- break the law, infringe anyone's rights, or upload content that is hateful, harassing, or sexually explicit;
- take a transaction off WAXED to avoid fees, or manipulate prices, reviews, or feedback;
- send spam, or use other users' details for anything other than the transaction they relate to;
- harass, threaten, bully, or impersonate anyone, or get around a block, suspension, or ban (for example, by opening another account);
- scrape, copy, or resell WAXED's catalog or pricing data beyond what our public API and MCP server allow;
- probe, disrupt, or overload the Service, get around its limits or security, or access accounts that are not yours;
- use the support assistant or any automated feature to generate content unrelated to WAXED.
Community standards, reporting, and blocking
WAXED has zero tolerance for objectionable content and abusive users. Objectionable content includes content that is hateful, harassing, threatening, sexually explicit, violent, discriminatory, or defamatory, content that promotes illegal activity, and spam or scams. Abusive users include anyone who harasses, threatens, impersonates, or defrauds another user, or who evades a block or a ban.
You can report any listing, profile, storefront, review, crate, or message from within WAXED using the Report option, or by emailing info@waxed.market. You can block any user from their profile or from a conversation; a blocked user cannot message you, and their listings, profile, and reviews are hidden from you.
We review reports within 24 hours. If content or conduct breaks these terms, we remove the content and may warn, suspend, or permanently ban the account responsible. Serious or repeated violations result in a permanent ban, and banned users may not open a new account.
Buying and selling
Sellers are responsible for their listings: accurate descriptions and condition grades, honest photos, having the item on hand, shipping it promptly and securely once it sells, and any taxes or legal obligations of their business. Sellers must complete Stripe's onboarding to receive payouts, and payouts are subject to Stripe's terms.
Payouts before setup. If you make a sale before your Stripe payouts are set up, WAXED holds your share of that sale and sends it to you as soon as setup is finished. We'll remind you along the way. If the order hasn't shipped within 14 days of the sale, we cancel it and refund the buyer in full. If you've already shipped it, the order stands and we keep holding your money until you finish setup. Money that stays unclaimed for a long time may be handled as unclaimed property under applicable law.
Buyers agree to pay for what they order. A purchase is a contract between the buyer and the seller; WAXED is not the seller of items listed by others.
Problems with an order. If an item does not arrive or is significantly not as described, contact the seller first, then us at info@waxed.market. We may help resolve disputes and, where appropriate, issue refunds or reverse payouts, but we do not guarantee any particular outcome. Chargebacks and payment disputes are also handled under Stripe's rules.
Third-party services
WAXED works with services we do not control. Catalog information includes data from Discogs. Listening links and playback use Apple Music, Spotify, and YouTube; when you connect or play through one of them, that service's own terms and privacy policy apply, and you may need your own account or subscription with it. Sellers may choose to connect Discogs, Square, or Shopify accounts to sync inventory. Payments run on Stripe and shipping labels on Shippo.
We are not responsible for third-party services, their availability, or their content.
WAXED's intellectual property
The Service — its software, design, the WAXED name and marks, and the data we compile, including our catalog, pricing, recognition, and grading data — belongs to WAXED or its licensors and is protected by law. These terms give you a personal, revocable, non-transferable right to use the Service as intended, and nothing more. Album artwork and music belong to their respective rights holders.
If you believe content on WAXED infringes your copyright, email info@waxed.market with the details, and we will review it and remove infringing material.
If you send us feedback or ideas, we may use them without any obligation to you.
Disclaimers
The Service is provided "as is" and "as available." To the fullest extent the law allows, WAXED makes no warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that catalog data, price estimates, scan matches, or answers from the automated support assistant are accurate. We do not guarantee the quality, safety, or legality of items listed by sellers.
Limitation of liability
To the fullest extent the law allows, WAXED and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the fees you paid WAXED in the 12 months before the claim arose and (b) US$100.
Some jurisdictions do not allow these limits, so they may not all apply to you. Nothing in these terms limits liability that cannot be limited by law.
You agree to indemnify WAXED against claims arising from your content, your listings or sales, or your breach of these terms.
Suspension, termination, and account deletion
You can stop using WAXED at any time, and delete your account in Settings. Deleted accounts are removed from public view immediately and permanently deleted, with their personal data, after a 30-day grace period in which signing back in restores them. Records we must keep by law (such as transaction records) are retained as the Privacy Policy describes, and scan photos are de-identified rather than deleted.
We may suspend or close an account, or remove content, if we reasonably believe it breaks these terms or the law, puts other users at risk, or exposes WAXED to liability — including immediately and without notice for a zero-tolerance violation described in Community standards. Where appropriate we will tell you why. Orders already placed must still be completed or refunded.
Sections that by their nature should survive termination — including content licences already granted, intellectual property, disclaimers, limitation of liability, and governing law — survive it.
If you use the WAXED iOS app
These additional terms apply when you download the WAXED app from Apple's App Store.
- By using the app you agree to these terms, including the Community standards; there is no tolerance for objectionable content or abusive users.
- These terms are between you and WAXED, not Apple. WAXED, not Apple, is responsible for the app and its content.
- Your right to use the app is limited to Apple-branded devices you own or control, as allowed by the Usage Rules in Apple's Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for the app.
- WAXED, not Apple, is responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your use of it infringes their intellectual property rights, WAXED, not Apple, is responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms, such as your wireless data service agreement, when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Questions, complaints or claims about the app: info@waxed.market, or WAXED Industries, LLC, 484 Harman Street, 1F, Brooklyn, NY 11237.
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Disputes will be resolved exclusively in the state or federal courts located in Kings County or New York County, New York, and you and WAXED consent to their jurisdiction. If you are a consumer, you also keep any protections the law of your country of residence gives you that cannot be waived by contract.
Changes to these terms
We may update these terms. We will change the date at the top of this page and give notice of material changes by email or in the app before they take effect. Continuing to use WAXED after that means you accept the updated terms.
If any part of these terms is found unenforceable, the rest remains in effect. These terms and the Privacy Policy are the whole agreement between you and WAXED about the Service.
